Part 108 BVLOS Rule: Status Tracker (Proposed)
Where the proposed FAA beyond-visual-line-of-sight rule stands and what it could mean for delivery programmes. Last checked 20 October 2026.
Current status
Part 108 is a PROPOSED FAA rule intended to create a standard pathway for routine BVLOS operations, including package delivery. Until a final rule takes effect, delivery operators continue to rely on Part 135 certificates, exemptions, waivers and site-specific approvals. Treat any claim of "Part 108 approval" with caution. Last checked 20 October 2026; check faa.gov for the latest status.
What the proposal covers
The proposal addresses operating permits and certificates for BVLOS operations, aircraft design and performance expectations, operator responsibilities, and how drones share airspace with crewed aircraft, including use of automated data services for traffic awareness.
What it means for buyers
If you are planning a programme for 2026–2027, design it to work under today’s authorities and ask suppliers how they will transition if Part 108 is finalised. Avoid contracts that depend on a rule that does not yet exist.
Keep watching
Final rule timing, effective dates and any phase-in periods can change. We update this page when the status changes, but the FAA is the authoritative source.
